ENCORE AUDIO END-USER LICENCE AGREEMENT
Version 1.0, October 2026
Copyright © 2026 Winston Joseph-Ward. All rights reserved. Encore Audio is a trade mark of Winston Joseph-Ward.

This agreement is between you and Encore Audio, operated by Winston Joseph-Ward in England ("we", "us"). It covers the Encore Audio music server for Windows and the Encore Audio apps for phones and tablets (together, "the Software"). By installing or using the Software you agree to these terms. If you don't agree, don't install or use it.

1. WHAT YOU MAY DO
1.1 We grant you a personal, non-exclusive, non-transferable licence to install and use the Software for playing your own music collection at home and on your own devices.
1.2 Trial. You may use the Software free of charge for the trial period shown in the Software. After that, a licence key is needed to keep using the server.
1.3 Licence key. Each licence key covers the number of Encore Audio servers stated when you bought it. You may move it to a new computer by deactivating it on the old one.
1.4 Apps. The phone and tablet apps are free, and you may install them on as many of your own devices as you like, for use with your own Encore Audio server.
1.5 The licence covers updates to the version you bought. We may offer future major versions as paid upgrades. The version you have keeps working either way.

2. WHAT YOU MAY NOT DO
You may not, except where the law expressly allows it:
(a) copy, sell, rent, lend or redistribute the Software or licence keys;
(b) share a licence key with people outside your household, or use one key on more servers than it covers;
(c) remove or get round the licence checks;
(d) reverse engineer, decompile or modify the Software (the law of England and Wales allows some decompilation for interoperability, and nothing here takes that right away);
(e) use the Software to run a commercial music service or to play music in public, which needs its own licences from music rights organisations.

3. YOUR MUSIC
3.1 The Software plays music that you provide. It does not supply music. You are responsible for having the right to own and play the music in your library.
3.2 The Software only reads your music files. It does not change, move or delete them.

4. INTERNET SERVICES AND RADIO
4.1 Some features use services run by others: MusicBrainz, Wikipedia and the Cover Art Archive (album and artist information), radio-browser.info and the radio stations themselves (internet radio), AutoEQ on GitHub (headphone profiles), and a public-address lookup (ipify) for remote access. These are provided by their owners, may change or stop, and have their own terms.
4.2 Radio stations are run by their broadcasters. We don't control what they broadcast or whether their streams stay available.

5. REMOTE ACCESS
Remote access lets your own paired devices reach your server over the internet. It is turned off until you turn it on. When it is on, you are responsible for your router and network settings. The connection is encrypted and only works for devices you have paired, but no internet-connected service can be guaranteed to be completely secure.

6. PRIVACY
The Software doesn't track you, show adverts or sell data. Your library, settings and listening history stay on your own devices. It contacts the services in section 4, and our licence service to check your licence key, only to do what you've asked. Our privacy policy at https://encoreaudio.co.uk has the details.

7. LOOK AFTER YOUR HEARING
The Software can raise levels (for example with preamp, bass, treble and EQ settings). Start at a low volume, especially with headphones, and avoid listening at high volume for long periods.

8. OPEN-SOURCE COMPONENTS
The Software includes open-source components, each under its own licence. Those licences apply to those components, and nothing in this agreement limits the rights they give you. The Software lists them in its About or Licences section.

9. UPDATES AND CHANGES
We may release updates that fix problems, add features or change how features work. We may update this agreement; if we do, the new version will apply to updates you choose to install, and we'll show it to you.

10. ENDING THIS AGREEMENT
You may stop using the Software at any time by uninstalling it. If you seriously break this agreement (for example by sharing licence keys), we may end your licence by telling you, and you must then stop using the Software.

11. WARRANTY
11.1 If you are a consumer, you have legal rights in relation to software that is faulty or not as described, under the Consumer Rights Act 2015. Advice about your legal rights is available from Citizens Advice. Nothing in this agreement affects those rights.
11.2 Otherwise, and as far as the law allows, the Software is provided "as is". We don't promise that it will work with every streamer, phone, network or music file, or that it will be free of errors.

12. OUR LIABILITY
12.1 Nothing in this agreement limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
12.2 Otherwise, we are not responsible for losses that were not foreseeable, for loss of data you could have backed up, or for losses to a business. Our total liability to you is limited to the amount you paid for the Software.

13. GENERAL
13.1 This agreement is the whole agreement between us about the Software.
13.2 If a court decides part of it is unenforceable, the rest still applies.
13.3 This agreement is governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
